Emery Z. Toth

Other areas of law that Mr. Toth has been engaged in include:  Zoning Board attorney for the Borough of Carteret, Township of Woodbridge, Borough of South River and City of Perth Amboy. He was also the Associate Project Director for the Office of Inmate Legal Services at the former Rahway state prison, which is now East Jersey State. Mr. Toth has extensive experience in Administrative Law and has been appointed as a Hearing Officer for civil service preliminary disciplinary proceedings. He has handled cases in the Superior Court of Appellate Division and has argued before the New Jersey Supreme Court.

One of his cases – Rahway Prison vs Otis Henry, 81 N.J. 571(1980)  is a case that is cited frequently in civil service Appellate practice dealing with progressive discipline. Mr. Toth recently successfully defended a private school in a 5-day jury trial where his client was charged with allegations of wrongful termination, hostile work environment, harassment and violations of the New Jersey State Conscientious Employee Protection Act.

He has participated in a seminar that has taught young attorneys how to represent their clients in Municipal Court. Mr. Toth has been a panelist at Various ICLE institutions and was a guest lecture at annual meetings at the NJ State Bar Association. Some of the seminars and courses given by Mr. Toth include “Representing Your Client In Municipal Court” and “Municipal Court Winning Strategies".  Mr. Toth was given a special award by The National Judicial College in recognition for his completion of a course entitled “Improving the Adjudication of DWI/Traffic Safety Cases.” He was a guest lecturer for the Lorman Legal Institute covering DWI Law and other related municipal court topics. 

Emery Z. Toth, Esq. is admitted to the NJ Bar. He received a bachelor of art degree from Seton Hall and earned his J.D. Law Degree from Ohio Northern College of Law. His law practice centers around criminal and municipal court trial practice, family law, divorce, domestic violence restraining orders, and commercial litigation.

Mr. Toth has extensive experience and knowledge in Municipal Court practice. For 25 years, he has served as a Municipal Court Judge in various jurisdictions. He was the Chief Municipal Court Judge for the Township of Woodbridge, the Township of Edison, the Borough of Sayreville, as well as a Judge in the Perth Amboy, Old Bridge and South River Courts. During his 25 years as a Municipal Court Judge, he has given numerous lectures and participated in various seminars and continuing legal education programs dealing with Municipal Court practice, with emphasis on DWI Law.
